Facilities Managers Face Personal Prosecution for Non-Compliant Operations

Recent outbreaks of the potentially deadly Legionella bacteria in five North East England police stations, as well as further outbreaks in a Manchester office building and a Dorset school, have once again highlighted the health risks associated with Legionnaire’s disease and the importance of precautionary measures by public sector managers.
The requirement for organisations with over five employees in a facility that stores hot and cold water to act in accordance with the Control of Legionella Bacteria in Water Systems (L8) code of practice has particular resonance for public sector management. First, if there is no Legionella control plan, then the organisations public liability insurance could be cancelled. Second, due to new corporate manslaughter legislation enacted in 2007, there is a risk of personal prosecution for managers seen to act negligently.
